At Chaiz Inc. ("Chaiz," "us," "we," or "our"), we take the privacy of your personal information seriously. This Privacy Policy describes how we collect, use, disclose, and protect your information when you visit or use our website at www.chaiz.com and all related digital services (collectively, the "Website").

Our Website provides a marketplace for you to search, compare, and purchase vehicle protection Products (hereafter “Services”).  “Products” including Vehicle Service Contracts ("VSCs") and other coverage products we may offer from time to time. VSCs are not "auto warranties" as defined under federal law, but do provide coverage for certain vehicle repairs or services. 

Product purchases through our Website are not available in all states. Our Website may also display offerings from third-party partners. See "Third-Party Links and Services" below for details.

Information We Collect

We collect only the personal information that is adequate, relevant, and reasonably necessary to provide our Services and fulfill the purposes described in this policy. The types of personal information we collect depend on how you interact with us.

Information You Provide to Us

When you use our Website, you may provide us with:

  • Identity and contact information. Your name, email address, phone number, and mailing address.
  • Vehicle information. Year, make, model, vehicle identification number (VIN) or license plate , mileage and State of registration.
  • Payment information. Payment card details used to purchase a Product. See "Payment Information" below for details on how we handle this data.
  • Purchase preferences. Your coverage preferences and language settings.

Information We Receive from Partners and Agents

We may receive your personal information from third-party partners, agents, or representatives through several channels:

  • A partner or agent may provide your contact information (name, phone number, email address, and in some cases physical address) to us directly, for example via an API integration or during a phone transfer, where you have consented to your details being shared with Chaiz for the purpose of receiving information about vehicle protection products.
  • A partner or agent acting on your behalf may enter your information into our Website and complete a purchase on your behalf, or help you explore coverage options.
  • A partner may direct you to our Website via a link (for example in an email), after which any information you provide on our Website is collected by us directly.

Information We Collect Automatically

When you visit our Website, we automatically collect certain technical and usage information, including:

  • Device and browser information. Your IP address, browser type and version, operating system, device type, and unique device identifiers.
  • Usage data. Pages you visit on our Website, time and date of your visit, time spent on each page, links you click, and referring URLs.

Information We Do Not Collect

We do not collect your age, gender, precise GPS-level geolocation, biometric data, government-issued identification numbers, or user-generated content such as photos, videos, or social media posts.

Payment Information

When you purchase a Product, we collect your payment card information to process your transaction. If you choose a monthly payment plan, we share your payment card details with the relevant Payment Plan Provider so they can process your recurring payments. The “Payment Plan Provider” is the finance company that processes your periodic payments when you purchase Products and is subject to a separate agreement which is provided to you .

We do not store your full payment card number. Card information is processed in transient memory and transmitted directly to the Payment Plan Provider without being written to our systems. We retain only the last four digits of your card number for identification purposes (for example, so you can confirm which card is on file). We retain a record of the initial downpayment transaction for tax and accounting purposes. All subsequent recurring payment records are held by the Payment Plan Provider.

Cookies and Tracking Technologies

We use cookies and similar technologies (including localStorage, sessionStorage, pixels, and web beacons) from the following categories of partners:

Analytics, advertising, and affiliate partners. We share identifiers and browsing data with Google, Meta, Microsoft, Mixpanel, Impact.com, Microsoft Clarity, and MNTN (including MNTN's connected television advertising partners) for advertising measurement, campaign optimization, affiliate tracking, session replay, connected TV advertising, advertising suppression for existing customers, and user experience analysis. 

Session replay and behavior analysis. We use Microsoft Clarity and Mixpanel, which record how visitors interact with our Website, including mouse movements, clicks, scrolling, and form interactions. Input fields are masked during session replay to prevent exposure of personal or sensitive information.

Fraud detection (strictly necessary). We use ClickCease to detect and prevent click fraud on our advertising campaigns. ClickCease collects technical data, including IP addresses, device information, and click behavior. We consider this processing strictly necessary to protect our Services and your experience. ClickCease operates regardless of your opt-out preferences.

Error monitoring (strictly necessary). We use Sentry to detect and diagnose technical errors on our Website. Sentry may collect your IP address and technical information about your browser and device when an error occurs. This data is used solely to identify and fix technical issues. Sentry operates regardless of your opt-out preferences.

First-party cookies and storage. We use session-based and persistent client-side storage to remember your preferences and enable core functionality.

Connected TV and cross-device advertising. We use MNTN, a connected television (CTV) advertising and measurement provider, to deliver digital and connected TV advertisements and to suppress further advertising to visitors who have already purchased a Product. MNTN's technology collects a unique user identifier, your IP address, device identifiers, your Google Analytics identifier (where applicable), and information about your interactions with our Website, and may combine this information across your devices. If you complete a purchase, we share limited conversion information (such as an order identifier, order amount, and product category) with MNTN so that its connected TV advertising partners can avoid showing you further advertising for that Product. MNTN does not receive your name, email address, vehicle information, or payment details from us. 

Under applicable state privacy laws, our sharing of data with analytics, advertising, session replay, and affiliate partners may be considered a "sale" or "sharing" of personal information. See "Your Opt-Out Rights" below.

Your Cookie Choices

When you first visit our Website, we display a cookie banner that gives you the choice to accept or manage your tracking preferences. You can:

  • Accept — analytics, advertising, and session replay technologies will be active during your visit.
  • Manage Preferences — opens a preference panel where you can opt out of analytics and advertising tracking.

If you do not interact with the banner, analytics and advertising technologies will remain active until you opt out. You can change your preferences at any time by clicking the "Do Not Sell or Share My Personal Information" link in the footer of our Website or by enabling Global Privacy Control (GPC) in your browser.

Strictly necessary technologies (fraud detection and error monitoring) operate regardless of your cookie preferences.

How We Use Your Information

We use your personal information for the following purposes:

  • Providing our Services. Generating quotes, processing purchases, and managing your account.
  • Outbound contact. If you have provided your contact details to one of our partners and consented to being contacted, we may reach out to you by phone or email regarding our Products.
  • Customer support. Responding to your inquiries via email and phone. We may record phone calls for service quality and compliance purposes. You will be notified at the start of any call that may be recorded; by continuing the call, you consent to the recording.
  • Website improvement. Analyzing usage patterns, understanding how visitors interact with our Website, and improving our Services.
  • Marketing. Sending you information about Services similar to those you have purchased or inquired about, unless you have opted out. You may opt out at any time by contacting us, following the unsubscribe instructions in any marketing communication, or through your account settings.
  • Advertising measurement. Measuring the performance of our marketing campaigns and compensating our referral and affiliate partners.
  • Fraud prevention and security. Detecting, preventing, and addressing fraudulent activity, technical issues, and threats to our Website.
  • Legal compliance. Complying with applicable laws, regulations, and legal obligations.
  • Purchase follow-up. If you begin but do not complete a purchase, we may contact you by email or phone to help you complete your order or answer any questions about coverage options. You may opt out of these communications at any time by following the unsubscribe instructions in the email or by asking us to stop calling.

We process your personal data only for the purposes disclosed in this policy or for purposes reasonably compatible with those purposes. If we wish to process your data for a materially different purpose, we will notify you and, where required by law, obtain your consent.

How We Share Your Information

We share your personal information with the following categories of third parties:

Product providers ("Providers"). We share your vehicle information, contact details (including your phone number), and payment information with the relevant Provider so they can underwrite and service your contract. Your phone number is shared so the Provider can contact you regarding claims, coverage queries, and contract administration. This sharing is necessary to provide our core Services.

Payment Plan Providers. If you select a monthly payment plan, we share your payment card information and phone number with the relevant Payment Plan Provider so they can process recurring payments and contact you regarding missed payments or account administration.

Service providers and processors. We engage service providers to help us deliver our Services. These include:

  • Segment (data infrastructure)
  • Microsoft Azure and Cloudflare (hosting and security, including rate limiting)
  • HubSpot (customer relationship management, live chat, knowledge base, and email marketing)
  • SendGrid (transactional email)
  • Cloudtalk (phone support and outbound calls, including call recording for service quality and compliance)

Sentry (error monitoring)

These providers process personal data on our behalf under their standard data processing terms, which include obligations to protect your data and limit their use of it to the purposes for which it was disclosed.

Advertising, analytics, and affiliate partners. We share identifiers and browsing data with Google, Meta, Microsoft, Mixpanel, Impact.com, and Microsoft Clarity for advertising measurement, campaign optimization, affiliate tracking, session replay, and user experience analysis. Under applicable state privacy laws, this may be considered a "sale" or "sharing" of personal information.

In the preceding twelve months, we have shared the following categories of personal information with these partners: identifiers (such as cookie IDs, IP addresses, and device identifiers), internet or electronic network activity information (such as browsing behavior and session interaction data on our Website), and inferences drawn from this information.

Fraud detection providers. We share technical data (IP addresses, device information, click behavior) with ClickCease for advertising fraud prevention. We consider this sharing strictly necessary for security purposes.

Law enforcement or legal authority. We may disclose your information where required by law, to comply with a court order or legal process, to protect our rights or property, or to protect the safety of our users or the public.

Business transfers. If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of such a change before it materially affects how your information is processed.

Sale of Personal Information

We do not sell your personal information in exchange for monetary payment.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, provide our Services, and comply with our legal obligations. Specifically:

  • Account and identity information. Retained for the duration of your account and for 3 years after VSC completion, cancellation, or your last interaction with us. This period supports potential warranty-related inquiries, customer service requests, and legal obligations.
  • Downpayment transaction records. Retained for 7 years after the transaction to comply with tax and accounting obligations.
  • Partner lead information. If we receive your contact information from a partner and are unable to connect with you, we delete your information within 10 days of receipt. If we do connect, your information is retained in accordance with the account retention period above.
  • Usage data and cookies. Retained for up to 12 months from the date of collection.
  • Connected TV and advertising vendor data. Data collected through MNTN's tracking technology is retained by MNTN for up to 2 years from your last visit to our Website, in accordance with MNTN's own data retention practices, for advertising delivery, measurement, and fraud-prevention purposes. 
  • Marketing communications data. Retained until you opt out, after which we retain only enough information to honor your opt-out preference.
  • Call recordings. Retained for the duration of your account and for 12 months after VSC completion, cancellation, or your last interaction with us. for quality assurance and compliance purposes.

When personal information is no longer required, we securely delete or de-identify it.

Your Privacy Rights

Depending on your state of residence, you may have the following rights regarding your personal information:

Right to Know and Access. You may request that we disclose what personal information we hold about you, where we collected it from, why we collected it, and who we have shared it with. We will compile the relevant records from our systems and provide them to you in a readable format.

Right to Delete. You may request that we delete your personal information. If you have an active contract, we may not be able to delete information that is necessary to fulfill that contract. In such cases, we will delete the information once the contract ends and the applicable retention period expires.

Right to Correct. You may request that we correct inaccurate personal information we maintain about you.

Right to Data Portability. You may request a copy of your personal information in a structured, machine-readable format (such as CSV). For Chaiz customers, this typically includes your contact details, vehicle information, and contract details.

Right to Opt Out of Sale or Sharing. You may direct us to stop sharing your personal information with advertising, analytics, and affiliate partners. See "Your Opt-Out Rights" below.

Right to Limit Use of Sensitive Personal Information. Where we process sensitive personal information (such as payment card data), you may request that we limit our use to what is strictly necessary to provide our Services. Since we process payment card data only transiently and do not store it, this right has limited practical application for our Services, but you may still exercise it.

Right to Non-Discrimination. We will not deny you Services, charge you different prices, or provide a different quality of service because you exercise any of these rights.

Right to Appeal. If we decline to act on your privacy request, we will inform you of the reason and provide instructions for how to appeal. You may submit an appeal by emailing [email protected] with the subject line "Privacy Request Appeal." We will respond within 60 days. If your appeal is denied, we will provide you with information on how to contact your state's Attorney General.

How to Submit a Request

We will confirm receipt of your request within 10 business days and respond within 45 calendar days. If we need additional time, we will notify you of the extension and the reason. In no event will we take longer than 90 calendar days from the date of your original request.

To protect your privacy, we may need to verify your identity before fulfilling your request. We will ask you to confirm information we already hold about you (such as your email address, vehicle details, or contract details). We will not require you to create a new account solely to submit a request.

Authorized Agents

You may designate an authorized agent to submit a privacy request on your behalf. If you use an authorized agent, we may require (a) signed written permission from you authorizing the agent, and (b) verification of your own identity. We may waive these requirements if the agent provides a valid power of attorney under applicable state law.

Your Opt-Out Rights

We share data with advertising, analytics, session replay, and affiliate partners as described in "How We Share Your Information" above. Under applicable state privacy laws, this may be considered a "sale" or "sharing" of personal information.

You may opt out of this sharing at any time by:

  • Clicking the "Do Not Sell or Share My Personal Information" link in the footer of our Website
  • Enabling Global Privacy Control (GPC) in your browser (visit https://globalprivacycontrol.org for details)

Because tracking opt-out is applied at the browser level, it must be set in each browser you use to visit our Website. For all other privacy requests (such as data access, deletion, or correction), contact us at [email protected].

We recognize and honor GPC signals. When we detect a GPC signal, we treat it as a valid opt-out request and will display a confirmation on our Website.

When you opt out, we will stop sharing your data with advertising and analytics partners and disable session replay recording. We will continue to collect anonymous, aggregate usage data to improve our Website. Fraud detection (ClickCease) and error monitoring (Sentry) will continue to operate as they are strictly necessary for security and functionality.

Sensitive Personal Information

When you purchase a Product, we transiently process your payment card information to complete the transaction and transmit your details to the Payment Plan Provider. We do not store your full card number in our systems. Since we only process this data in memory and do not retain it, the practical scope of sensitive personal information we hold is limited.

You may request that we limit our use of sensitive personal information by contacting us at [email protected] or by clicking the "Limit the Use of My Sensitive Personal Information" link on our Website.

Additional Rights for California Residents

This section applies to residents of California under the California Consumer Privacy Act and the California Privacy Rights Act (CCPA/CPRA).

VSC purchases, Mechanical Breakdown Insurance (MBI), and other Products are not available to California residents through our Website. However, California visitors may browse and view partner offerings. During these visits, our advertising and analytics technologies collect personal information as described in "Cookies and Tracking Technologies" above. All rights and opt-out mechanisms described in this policy apply to this data.  This includes connected television advertising delivered through MNTN, which may target or suppress advertising based on your browsing activity on our Website regardless of whether you are able to purchase a Product. 

We do not sell or share the personal information of consumers we know to be under 16 years of age.

Additional Rights for Texas Residents

This section applies to residents of Texas under the Texas Data Privacy and Security Act (TDPSA).

If you are a Texas resident, the rights described in "Your Privacy Rights" above apply to you, including the right to confirm whether we are processing your personal data, access that data, correct inaccuracies, request deletion, obtain a portable copy, and opt out of targeted advertising, the sale of your personal data, or profiling that produces legal or similarly significant effects.

Under the TDPSA, financial information is classified as sensitive and requires your consent before processing. When you provide payment card information to purchase a Product through our Website, your submission constitutes your consent to our transient processing of that data for the purpose of completing your transaction and forwarding payment details to the Payment Plan Provider.

Data Protection Assessments

Where required by applicable law, we conduct data protection assessments for processing activities that may present a heightened risk to consumers, including targeted advertising and the sharing of personal data with third parties.

Children and Minors

Our Services are intended for adults aged 18 and over. We do not knowingly collect personal information from children under 13 years of age. If we learn that we have collected personal information from a child under 13, we will promptly delete it.

We do not sell or share the personal information of consumers we know to be under 16 years of age. If we become aware that a consumer is between 13 and 15 years of age, we will not sell or share their personal information unless we receive affirmative opt-in consent from the consumer's parent or guardian.

Governing Law

This Privacy Policy is governed by the laws of the State of Delaware, without regard to conflict-of-law principles, as further described in our Terms of Use. This choice of law shall not deprive you of any mandatory consumer protections under the laws of your state of residence.
